The following Terms of Service (“Terms”) apply to your use of the monday.com marketplace app (“the App”) developed and owned by DevSamurai (“we” or “us”). By using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
Use of the App
You may use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- To engage in any activity that interferes with or disrupts the App or the servers and networks used to operate the App.
- To transmit any unsolicited or unauthorized advertising, promotional materials, or spam.
- To impersonate or attempt to impersonate DevSamurai , a DevSamurai employee, or another user.
Intellectual Property
The App and its entire contents, features, and functionality are owned by DevSamurai or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the App without our prior written consent.
Warranty Disclaimer
The App is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted.
Limitation of Liability
In no event shall DevSamurai , its affiliates, or their respective directors, officers, employees, or agents be liable for any indirect, consequential, special, or punitive damages, including, without limitation, lost profits, arising out of or in connection with the use or inability to use the App.
Indemnification
You agree to indemnify and hold DevSamurai , its affiliates, and their respective directors, officers, employees, and agents harmless from any claims, liabilities, damages, and expenses, including reasonable attorneys’ fees and costs, arising out of or in connection with your use of the App or any violation of these Terms.
Termination
We may terminate your access to the App at any time and for any reason, without notice or liability. Upon termination, all provisions of these Terms that by their nature should survive will survive, including, without limitation, intellectual property, warranty disclaimer, limitation of liability, indemnification, and dispute resolution.
Governing Law
These Terms will be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
Changes to these Terms
We may update these Terms from time to time. If we make any material changes to these Terms, we will notify you by email or by posting a notice in the App.
